Representatives of Directorate take part in working out of data base for the National Programme for integration of the Republic Serbia in European Union (NPI)

The representatives of Directorate for Railways, as members of the Subgroup for transport and Subgroup for Trans-European Networks within the Expert Group of the Coordinating Body of the Serbian Government for the process to join the European Union, have taken part in coordinated activities of the state bodies in working out the Database for the National Program for Integration of the Republic of Serbia in European Union.

 

Each of the 35 subgroups of the  Expert Group of the Coordinating Body has the following competences: coordination of the activities relating to the strict area of its scope; distribution of EU "acquis communautaire" according to the competences of state administration bodies - appointing of competent ministry for each part of Acquis; coordination, preparation and carrying out the review of the Acquis chapters; coordination and harmonization of legislation within the given subgroup area; resolving the issues of the eventual disagreement relating to competence. ■

 

 

In 2007 Directorate has issued 2 licences, 2 certificates and 88 permits

In 2007 Directorate for Railways has issued 2 licences for carriage in railway transport 2 certificates on safety for carriage in railway transport.

 

Last year Directorate has issued altogether 88 permits for usage of railway rolling stock, parts and equipment for railway rolling stock and devices, parts and equipments for railway infrastructure (54 permits for usage of railway rolling stock, 12 permits for usage of parts and equipment for railway rolling stock and 22 permits for usage of devices, parts and equipment for railway infrastructure).

 

In the course of 2006 the Directorate has issued altogether 56 permits for usage of railway rolling stock, parts and equipment for railway rolling stock and devices, parts and equipments for railway infrastructure (45 permits for usage of railway rolling stock, 4 permits for usage of parts and equipment for railway rolling stock and 7 permits for usage of devices, parts and equipment for railway infrastructure). ■

 

 

In the 2007 the proposals for several significant normative documents had been made

Within its competences and pursuant to the Law on Railway and the Law on Safety in railway transport, Directorate for Railways has made the proposals for several significant normative documents in 2007. Beside others, the following had been made: Proposal of the Regulations on combined on railways; Proposal of the Transport regulations (Regulations 2); Proposal of the Regulations on maintenance, control and periodical inspection of railway rolling stock (Regulations 241) and Proposal of the Regulations on handling the speedometer devices on traction and other vehicles and processing the registration tape (Regulations 230).

 

Upon providing the positive opinion from the Ministry of Finance and the competent transport ministry (Ministry for Capital Investments, i.e. Ministry for Infrastructure) for the made-up proposals of the normative enactments, pursuant to the Government Internal regulations, they have been forwarded for further procedure according to the established proceeding.

 

The priority of all normative activities of Directorate for Railways has been the carrying out of laws and their harmonization with the international rules and standards, as well as with the EU legal inheritance. In the course of 2007 the representatives of Directorate took part in the activities of the international railway organizations and bodies, especially in the activities of the Intergovernmental Organisation for International Carriage by Rail (OTIF) and technical commissions. ■

 

 

Directorate for Railways issued the first Certificate on Transport Safety in railway transport, to "KOMBINOVANI TRANSPORT" d.o.o., Beograd / "COMBINE TRANSPORT" Ltd., Belgrade/

 

Belgrade, 24th September, 2007

 

Directorate for Railways has issued today the first Certificate on Transport Safety in railway transport, to the transport and trade company "KOMBINOVANI TRANSPORT" d.o.o., Beograd / "COMBINE TRANSPORT" Ltd., Belgrade/.The Certificate is issued for the freight transport - for 2 diesel-electric and 2 diesel-hydro mechanical locomotives with validity period from 24th September 2007 to 24th September 2008.

 

The Certificate is issued on the basis of the Law on Railways and the Regulations on conditions and content of the Certificate on Transport Safety in railway transport, whence the Commission for carrying out the procedure, inspecting the submitted documentation, established that all foreseen conditions had been fulfilled. ■

 

 

Prof. Dr. Kurt Spera from Austria visited Directorate for Railways

 

Belgrade, 14th September 2007

 

Mr. Slobodan Vukmirovic, Assistant Director of the Directorate for Railways, received yesterday Prof. Dr. Kurt Spera, eminent Austrian specialist and expert for international railway regulations. It has been commonly estimated that the cooperation between international organizations and national institutions in the filed of railway transport is necessary for development of international transport law which represents the reliable institutional framework for fulfillment of market demands.

 

The guest has been informed about the structure of railway sector in Serbia, internal organization and competences of Directorate in accordance with the Law on Railways, as well as the cross-section of up-to-date, current and future activities relating the issuing of licences and certificates and other professional, regulatory and other operations.

 

Beside other thing, Prof. Spera informed the representatives of Directorate that in Austria the ratification procedure of Convention concerning the international carriage by rail (COTIF)  is in progress. Also, he stressed the increasing competition on the railway market, where the Austrian Federal Railways (OeBB) has been competing with the 12 private railway companies.

 

Inofrmation and opinion on the current activities within international level relating to the usage and marking of wagons, functioning of the principle of free access to railway infrastructure, usage of industrial tracks and other issues have been exchanged.

 

During his visit to the Faculty of Transportation of Belgrade, Prof. Spera gave the lecture on "COTIF 1999" and "INCOTERMS 2000". The visit was organized by the Chamber of Commerce of Serbia, Association fro transport and Logistics and Association of Tariff experts of Serbia. ■

 

 

Directorate for Railways establishes the Registry of the Industrial
Tracks of the Republic of Serbia

 

Belgrade, 31st August 2007

 

Pursuant to the Law on Railway and the Law on Safety in Railway Transport, Directorate for Railways has started the establishing  of the Registry of the Industrial Tracks of the Republic of Serbia. The establishment of the Registry of the Industrial Tracks is the presumption for establishing legal and technical standards which come out from the Law on Railway.

 

According to the Law on Railway, the Industrial Track is "the railway track connected to the public rail infrastructure and serves for delivery and forwarding of goods to the owner, i.e. authorized user of such railway track". Industrial tracks include industrial tracks which do not poses traction rolling stock and the staff to operate it and industrial tracks which poses traction rolling stock and the staff to operate it.

 

All owners of the industrial track are obliged to report to Directorate for Railways all capacities they have on disposal. Registration is carrying out by filling in and sending the appropriate form.

 

Moreover, all owners of the industrial tracks are obliged to work out their Act on conditions for construction, reconstruction, maintenance and protection of industrial track, railway rolling stock and other resources manufactured according to the special technical norms and standards as well as for organization and regulation of the industrial track railway traffic. The managing body of the owner of industrial track enacts this Act, upon receiving the approval of the Ministry for Infrastructure for it.

 

Directorate for Railways is available to all owners of industrial tracks for giving information relating to the way of working out the "Act on conditions for construction, reconstruction, maintenance and protection of industrial track, railway rolling stock and other resources manufactured according to the special technical norms and standards as well as for organization and regulation of the industrial track railway traffic", also for the conditions and procedures for getting the permit for usage "the railway rolling stock and other resources manufactured according to the special technical norms and standards" which are used in railway traffic operation procedure. ■

 

 

EU-donated IT equipment delivered to the Directorate for Railways

 

Belgrade, 20th August, 2007

 

Directorate for Railways took over the package of the modern IT equipment within EU-donated and funded Capacity Building Project in the transport sector which has been realized by the European Agency for Reconstruction (EAR). The package consists of the following: 16 PC units, 3 lap-top computers, 3 digital cameras, 1 projector, 6 laser printers, 1 colour printer, 19 USB Flash drive units as well as 1 server with the accessories.

 

The above equipment has been delivered in the course of the last two years  as a part of the Project of technical assistance to the Ministry for Infrastructure (as previously to the Ministry for Capital Investments) and to the other state administration bodies dealing with transport. Directorate for Railways is especially grateful to the European Agency for Reconstruction and itۥs Operational Center in Belgrade, as well as to the Ministry for Infrastructure, for their engagement to provide and realize this donation. It is particularly important for the newly-established institutions such as Directorate for Railways. No doubt that this will upgrade technical capacities and improve efficiency of both day-to-day and overall activities of Directorate. ■

 

 

Directorate for railways has issued 90 permits

 

Belgrade, 9th July 2007

 

Directorate for Railways has issued altogether 90 permits for railway stock, equipment and devices for railway stock and railway infrastructure (until 30th June 2007).

 

Out of the above number, it have been issued 60 permits for usage of rolling stock, 11 permits for usage of equipment and devices for rolling stock and 19 permits for equipment and devices for railway infrastructure.

 

Pursuant to the Law on Railway, Directorate for Railways is also competent for carrying out the anticipated procedure and issuing of permits for usage of the newly-constructed railway stock, new types of devices, parts and equipment for railway rolling stock and infrastructure. ■ 

 

 

12 Enactments in the field of railway transport have been made up

Within its competencies pursuant to the Law on Railway, Directorate for Railways has made up 12 enactments in the field of railway traffic.

 

The following 7 Regulations have been made up, which were enacted by a Minister competent for transport affairs:

- Regulations on charges for issuing of the permit for usage of rolling stock, parts and equipment for railway rolling stock and devices, parts and equipment for railway infrastructure ("Official Gazette of the Republic of Serbia" No. 117/2005),

- Regulations on conditions for issuing and content of the certificate on safety for railway infrastructure management, i.e. industrial railway ("Official Gazette of the Republic of Serbia ", No. 39/2006),

- Regulations on conditions for issuing and content of the certificate on safety for carriage in railway transport ("Official Gazette of the Republic of Serbia ", No. 39/2006),

- Regulations on charges for issuing of the certificate on safety for railway infrastructure management, i.e. industrial railway ("Official Gazette of the Republic of Serbia ", No. 39/2006),

- Regulations on charges for issuing of the certificate on safety for carriage in railway transport ("Official Gazette of the Republic of Serbia ",  No. 39/2006),

- Regulations on charges for issuing of the licence for railway infrastructure management ("Official Gazette of the Republic of Serbia " No. 39/2006),

- Regulations on charges for issuing of the licence for carriage in railway transport ("Official Gazette of the Republic of Serbia ",  No. 39/2006).

 

Directorate also made up Ordinance on railway tracks classification ("Official Gazette of the Republic of Serbia " No. 75/2006), enacted by the Government of the Republic of Serbia .

 

Furthermore, Directorate for Railways made up the following 4 enactments which in the the Draft  form were forwarded in further procedure pursuant to the Rules of Procedure of the Government of the Republic of Serbia:

- Regulations on maintenance, control and periodical inspection of rolling stock,

- Regulations on the railway combine transport,

- Regulations on the official uniforms for the Serbian Railways,

- Instruction on technical-operating characteristics of the loading units and freight wagons in combine transport.   

 

 

Dialog between the representatives of Directorate for Railways and the World Bank form  Washington has continued

 

Belgrade, 28th February 2007

 

Mr. Sinisa Trkulja, Deputy Director of the Directorate for Railways (also currently holding the post of Acting Director), together with his associates, yesterday hold the talks with delegation of the World Bank from Washington, led by Mr. Richard Martin Humphreys, Senior Transport Economist, Sustainable Development Department. Hereby, the dialog on possibilities and modalities of the mutual cooperation, which commenced during the previous visit of WB delegation to Serbia in October last year,  has been continued.

 

The guests were informed more detailed on the main activities of Directorate in 2006. It has been stated that the issuing of the licences and certificates to the railway operators has not started yet, and thus they  have not been issued to the Public Enterprise "Serbian Railways" as well.

 

It has been indicated that in some cases Directorate has no authority to enact, but only to prepare the proposals of the necessary by-laws. That was one of the reasons why the Draft Law on changes and amendments of the Law on Railway was made and it is now in regular procedure. The second reason is the necessity of institutional protection of the national railway operator. Namely, according to the valid Law on Railway, the access to the railway infrastructure has been liberalized. However, the expected necessary presumption has non been realized - the program of the financial consolidation of Public Enterprise "Serbian Railways" has not been enacted, which is envisaged by the mentioned Law. Beside other things, also because the national railway carrier has not been ready for the international competition yet.

 

The representatives of the World Bank were informed that Directorate, according to the Law on Railway, has no influence on  the level of charging for usage of railway infrastructure. It is authorized only to make decisions on complaints relating to the assignment of routes. Accordingly, the Law on Railway defines the assignment of routes, but the methodology of the valuation of criteria given in the Law on Railway has not been defined. If the operator is not satisfied with the Infrastructure Manager decision, the Manager will act according to his opinion.

 

Mr. Richard Martin Humphreys emphasised that the process of providing of technical assistance to the Ministry for Capital Investments of the Republic of Serbia relating the development of the access to infrastructure regime and the Report on Serbian Railways network has been concluded. The consulting company (Booz Allen Hamilton) has been chosen as well. The Study, as a gift, is financed by the PPIAF. The Working group for elaboration of the Action Plan for further restructuring and financial consolidation of PE "Serbian Railways" has been set up.

 

Mr. S.Vukmirovic, M.Sc., Assistant Director of Directorate, pointed out that Directorate, pursuant to the Law on Railway, has been engaged in elaboration of the set of documents in the filed of railway transport, for which the Ministry for Capital Investments is competent as well. Furthermore, he emphasized that the Seminar on presentation of ISO 9000:2000 standards to the employees was organized in 2006. The preparatory activities for introduction of the quality system has commenced in 2007. At the same time, the experts form Directorate have been involved in the activities of the Ministry of Economy as well as in many other activities.

 

The representatives of the World Bank confirmed the readiness to participate in strengthening of the institutional capacities of Directorate for Railways. principally it has been agreed to consider commonly and more thoroughly the possibilities of future cooperation in this and other railway fields. One of those fields could be additional professional training and perfection of Directorate employees for executing the functions of regulatory body.   

 

Shaping of the modern regulatory frame for the functioning of the railway transport

Within the carrying out of the professional, regulatory and other activities set by the Law, Directorate for Railways, beside other things, has prepared and submitted to the Government of the Republic of Serbia the proposals of many regulations in the filed of railway transport to be considered and adopted.

 

The following regulations have been adopted and come into the force: Regulations on conditions for issuing and content of the certificate on safety for railway infrastructure management, i.e. for the industrial railways; Regulations on the conditions for issuing and content of the certificate on safety for carriage in railway transport; Regulations on charges for issuing of the certificate on safety for rail infrastructure management, i.e. industrial railway; Regulations on charges for issuing of the certificate on safety for carriage in railway transport; Regulations on charges for issuing of the licence for carriage in railway transport; Regulations on charges for issue of the licence for railway infrastructure management; Regulations on charges for issuing of the  permit for usage of rolling stock, parts and equipment for railway rolling stock and devices, parts and equipment for railway infrastructure; Regulations on the elements of the railway infrastructure and the Ordinance on railway tracks classification.

 

Additionally, Directorate for Railways also made up the proposals for the Regulations on railway combine transport; Regulations on the way of maintenance, control and periodical check-ups of rolling stock, and Regulations on the official uniforms for the Serbian Railways. The positive opinions have provided from the Ministry of Finance and the Ministry for Capital Investments. For those regulations and they have been forwarded to the Secretariat for Legislation for further procedure.

 

Within the activities relating to the international legislation in the field of traffic in general and railway transport, the proposal of the Law on ratification of the Protocol on changes of the Convention concerning International Carriage by rail (COTIF) was made up and submitted to the Ministry for Capital Investments for further procedure.

 

The following has been prepared  and submitted to Public Enterprise "Srbian Railways" to be published and applied : the text of the Uniform rules, i.e. supplements to COTIF, as well as he following executive regulations: General conditions for international railway passenger transport; Handbook on passenger transport documents; Handbook on passenger transport; Handbook on freight transport;  Handbook on international consignment note; Handbook on combine transport consignment note; Handbook on CIM/SMGS consignment note and the Handbook for re-forwarding in east/west transport.

 

Directorate for Railways made up in 2006 the following: Handbook on railway staff training relating to application of RID provisions; Plan and Program of railway staff training relating to application of RID provisions; examination set of texts for the railway staff relating to application RID provisions.

 

The list of international regulations were made both for passenger and freight, including all explanations and reasons to be put out of force, as well as the necessary exclusions and deadlines, and it was submitted to PE "Serbian Railways" for further proceeding.

 

The experts from Directorate for Railways participated in elaboration and adoption of the Agreement on international passenger transport and the Agreement on international freight transport.

 

Moreover, Directorate processed the documents submitted by the Intergovernmental Organization for International Carriage by Rail (OTIF) and International Institute for the Unification of Private Law (UNIDROIT) and it was done due to the scheduled Diplomatic conference on adoption of the Protocol on enacting the Convention on guaranteed rights for the mobile railway equipment. Directorate also made up and gave its opinion about the Convention, realizing the coordination of activities with other competent state bodies.

 

The experts form Directorate have prepared the documents for participation in the Commission for passenger transport and Commission for freight transport of the International Rail Transport Committee (CIT), and took part at the session and in the realization of conclusions.

 

Representatives of Directorate for Railways, on behalf of the Government of the Republic of Serbia, took part in OTIF General Assembly, made up the proposal of conclusions, necessary measures and activities of our country and submitted them to the competent ministries to be considered and realized.

 

The experts from Directorate also have participated in the following: elaboration of the draft Agreement between the Government of the Republic of Serbia and the Ministerial Cabinet of Ukraine relating to cooperation in the field of railway transport; took part in the work of Bilateral Commission Austria - Serbia, in the part relating to establishment of the basic concept of the Law on Cable Railway; organization, professional preparation and realization of the international seminar in the filed of application of international legislation relating to freight transport.

 

Moreover, the following information have been prepared and submitted to the other state bodies such as: setting up of new regular OTIF bodies, extension of the state competencies in international railway transport relating to usage of wagons, usage of infrastructure, technical acceptance of rolling stock and technical standards.

 

The proposal and the solution on the membership fees of our country in Intergovernmental Organization for International Carriage by Rail (OTIF) relating to the so called old debt (SFRY debt) and new debt as from 2001 were made up, as well as for the future debts.

 

In the course of 2006, pursuant to its administrative procedure authorizations, Directorate issued totally 52 permits: 3 permits for usage of devices, parts and equipment for railway infrastructure, 45 permits for usage of railway stock and 4 permits for usage of equipment and devices for railway vehicles.

 

In accordance with its competencies, in the course of 2006, Directorate for Railways approved technical documentation for six major projects relating to reconstruction and upgrading of the level crossing safety such as: level crossing at km 30+043 on Lapovo - Kraljevo - Djeneral Janovic - Macedonian border line; level crossing at km 34+062 on Lapovo - Kraljevo - Djeneral Jankovic - Macedonian border line; level crossing at km 155+449 on Lapovo - Kraljevo - Djeneral Jankovic - Macedonian border line; level crossing at km 102-890 on Subotica - Bogojevo - Croatian border line; level crossing at km 173+243 on Crveni Krst (Nis) - Zajecar - Prahovo River dock line; level crossing at km 51+815 on Belgrade - Mladenovac - Nis - Presevo - Macedonian border line, as well as the technical documentation of the General design for reconstruction of Batajnica - Golubinci section.

 

In the course of 2006, pursuant to its competencies, Directorate for railways gave an opinion for the following: Business Plan of Public Enterprise "Serbian Railways" for 2006; Maintenance program for public railway infrastructure, organization and regulation of railway transport in 2006; Business Plan of PE "Serbian Railways"  2006 - 2010, i.e. Strategic plan; Getting acquainted with the Business Plan of PE "Serbian Railways" elaborated by "Booz Allen Hamilton" 2006 - 2010.

 

The Analyses of the accident was made up according to the level of damage pursuant to the Data base and according to UIC Directive of 14th October 2004.

 

Within the regular activities, the insight was obtained relating to the way and procedure during the forming of reports on accidents in EU countries.

 

The Regulations on internal organization and job classification in Directorate for Railways were made up and came into the force on 9th June 2006. 

 

 

 

Mutual engagement of the experts of various profile - presumption for strengthening of the railway transport role

In Directorate for Railways we have a unique conviction that mutual engagement of the various creative potentials of experts is one of the inevitable presumptions for strengthening of the role of railway transport on the transport market. Comprehensive review  of the current processes is a presumption, beside other things, for creation of the adequate regulative frame, stressed Mr. Srdjan Spasojevic, Director of Directorate for Railways, Republic of Serbia, participating at the XII Scientific and Expert Conference on Railways - "ZELKON '06", held in Nis on 19th and 20th October 2006. More

 

Among the 97 papers and 174 authors from the 8 countries, 4 expert papers by the representatives of Directorate for Railways were presented as well. These papers dealt with the harmonization of the railway law, ecological safety during the transport of dangerous goods, treatment of dangerous goods in railway transport and human factor as a factor of safety in railway transport.  More  

 

 

 

Intensive preparations for working out the Draft Law on changes and amendments of the Law on Railway

 

 

Belgrade, 14th October 2006

 

At the meeting of the Working subgroup for working out the Draft Law on changes and amendments of the Law on Railway, held on Zlatibor mountain for 9th to 13th October 2006, the text proposals and many change and amendments oft this document have been harmonized (the Head of this Working subgroup is Mr. Sinisa Trkulja, Deputy Director)

 

Working subgroup is a part of the Working group for working out Draft Law on changes and amendments of the Law on Railway and working out the Draft Law on changes and amendments of the Law on safety in railway transport. The Group was set up by the Minister for capital investments and it includes the representatives of the Ministry for capital investments, Directorate for Railways, Government of Serbia Office for association to EU, Faculty of Transportation and Public Enterprise "Serbian Railways" (Head of the Working Group is Mr. Dejan Lasica, Assistant Minister for capital investments. 

 

 

 

Srdjan Spasojevic had discussions with the representatives of the World Bank from Washington

 

 

Belgrade, 9th October 2006

 

Mr. Srdjan Spasojevic, Director of Directorate for Railways, had discussions today with the delegation of the World Bank from Washington. Delegation was led by Mr. Richard Martin Humphreys, Senior transport economist within the transport unit, Sustainable development Dept. responsible for  Europe and Central Asia.  Mr. Spasojevic expressed readiness of Directorate to provide, within authorities, necessary information  and to contribute to the efficient realization of the objectives during the stay of the representatives of the World Bank in Belgrade. Moreover, he emphasized the readiness to contribute to the improvement of cooperation between the state bodies of the Republic of Serbia and the World Bank in the activities of the mutual interests  More
